Q: My father in law is in the process of selling his home, for sale by owner. The buyer brought an agent to the house. (By the way, buyer is a friend, the agent did not find the home). As far as we know, she did not disclose or have him sign any forms concerning compensation for sale of home. Now the closing is approaching and she wants my father in law to pay her 3% commission. What are his rights? He did not agree to any such thing. Please help! Thank you.

A: Your father-in-law is not obligated to pay a commission to anyone unless he has signed an agreement to do so.
It’s unlikely that commission will be a requirement of closing if there isn’t any documantation to support it.
